India's long standing problem Kashmir Conflict dates even from the day of Independence.Its been 65 years since Kashmir problem started,but still a solution has not been arrived.If we have too blame a person then it would be over our Politicians.Who keep on postpone the matter from finding a concrete solution.Kashmir is a complex problem with four corner having different stands over it.Neither anyone of the side don't have a concern over the Innocent Civilian In Kashmir.
In 5 Decade long problem in Kashmir thousands of soldiers,Militants and civilians have died.Every Minute we postpone Kashmir Problem from finding a solution makes thousands of life under risk.Kashmir a snow covered state looking like a head for India.Kashmir is a state of pride for Nationality's around it.No one has a concern over Innocent civilians of Kashmir. Even for People in India and Pakistan without knowing the truth and reality in Kashmir,they feel it has pride of there nation.So its Ideal that before we feel pride of Kashmir we must know whats happening in Kashmir.
History Of Kashmir-Conflict
Maharaja Hair Singh

Ranbir Singh's grandson Hari Singh, who had ascended the
throne of Kashmir in 1925, was the reigning monarch in 1947 at the conclusion
of British rule of the subcontinent and the subsequent partition of the British
Indian Empire into the newly independent Union of India and the Dominion of
Pakistan. An internal revolt began in the Poonch region against oppressive taxation
by the Maharaja.In August, Maharaja's forces fired upon demonstrations in
favour of Kashmir joining Pakistan, burned whole villages and massacred
innocent people.The Poonch rebels declared an independent government of "Azad"
Kashmir on 24 October.Rulers of Princely States were encouraged to accede their
States to either Dominion - India or Pakistan, taking into account factors such
as geographical contiguity and the wishes of their people. In 1947, Kashmir's
population was "77% Muslim and 20% Hindu".To postpone making a
hurried decision, the Maharaja signed a "standstill" agreement with
Pakistan, which ensured continuity of trade, travel, communication, and similar
services between the two. Such an agreement was pending with India.In October
1947, Pashtuns from Pakistan's North-West Frontier Province recruited by the
Poonch rebels, invaded Kashmir, along with the Poonch rebels, allegedly
incensed by the atrocities against fellow Muslims in Poonch and Jammu. The
tribesmen engaged in looting and killing along the way.The ostensible aim of
the guerilla campaign was to frighten Hari Singh into submission. Instead the Maharaja
appealed to Mountbatten for assistance, and the Governor-General agreed on the
condition that the ruler accede to India.Once the Maharaja signed the
Instrument of Accession, Indian soldiers entered Kashmir and drove the
Pakistani-sponsored irregulars from all but a small section of the state. India
accepted the accession, regarding it provisional until such time as the will of
the people can be ascertained by a plebiscite, since Kashmir was recognized as
a disputed territory. Kashmir leader Sheikh Abdullah endorsed the accession as
ad-hoc which would be ultimately decided by a plebiscite and is appointed head
of the emergency administration.The Pakistani government immediately contested
the accession, suggesting that it was fraudulent, that the Maharaja acted under
duress and that he had no right to sign an agreement with India when the
standstill agreement with Pakistan was still in force.

Sheikh Mohammed Abdullah
The leader of the National Conference, Kashmir's
largest political party, and one of the most important political figures in the
modern history of Jammu and Kashmir. He
introduced a resolution in the working committee of the Muslim Conference for
changing its name to National Conference on 24 June 1938 to allow people from
all communities to join the struggle against the autocratic rule of the
Maharaja.Hari Singh appealed to Lord Mountbatten of Burma the
Governor-General of India for Indian military aid. In his Accession Offer dated
October 26, 1947 which accompanied The Instrument of Accession duly signed by
him, the Maharaja Hari Singh wrote "I may also inform your Excellency's
Government that it is my intention at once to set up an interim Government and
ask Shaikh Abdullah to carry the responsibilities in this emergency with my
Prime Minister."
Lord Mountbatten accepted the accession after a meeting of
the Defence Committee on October 26, 1947. In accepting the accession
unconditionally he wrote "I do hereby accept this Instrument of Accession.
Dated this twenty seventh day of October, nineteen hundred and forty
seven".In the covering letter to Hari Singh. he wrote "In consistence
with their policy that in the case of any State where the issue of accession
has been the subject of dispute, the question of accession should be decided in
accordance with the wishes of the people of the State, it is my Government's
wish that, as soon as law and order have been restored in Kashmir and its soil
cleared of the invader, the question of the State's accession should be settled
by a reference to the people".Also in his letter to the Maharaja Lord
Mountbatten wrote "My Government and I note with satisfaction that your
Highness has decided to invite Sheikh Abdullah to form an Interim Government to
work with your Prime Minister. The support of Mahatma Gandhi and Jawaharlal
Nehru the Prime Minister of India was a key factor in getting Sheikh Abdullah
appointed as Head of the emergency administration by the Maharaja.
As a consequence, Sheikh Abdullah was appointed head of an
emergency administration by an order issued by the Maharaja which was undated
except for the mention October 1947 in place of the date.He took charge as Head
of the Emergency Administration on 30 October, 1947.After assuming the charge
of the Head of the emergency administration, he addressing his first meeting
with the government officers said "Pakistan is not our enemy and we have
the same respect for Mr Jinnah that we had previously. We want the Kashmir
issue to be settled by Dialog and if for this purpose I have to go to Karachi
to meet Mr Jinnah I am willing to go there".Sheikh Abdulla accepted to be with India,but he want more autonomy for states.
Human Right's In Kashmir
Indian Military & Security Force Human Right's Violation
India stationed around a half million Military and another half million Security forces.Human right's of civilian Kashmir people are under gun point of Army.Especially after provision of Armed Forces(Special Power),Act-1958,Which enable Armed personnel can kill anyone and they are protected from any type of inquiry.There are strong evidence about Indian armed personnel getting involved in fake encounter,rape,custody torture and mass killing.BBC and Wikileaks has reported about Human right's violation by Indian Armed forces.About thousands of Kashmir youth went missing over the years,many Human right activist believe they would be killed in fake encounter.A unidentified grave of over 10,000 people has been found in Kashmir.All this matter has been brought to the notice of Indian Government,but they continuously decline the charges over them.
Something to Think:More than 60 Years Kashmir has been with India,But we have failed to win the Hearts of Kashmir people?Who should be blamed Governement,Politician's or People?
Militants:-
Post-1989, Kashmiri Pandits and other minority
groups in Jammu and Kashmir have been targets of ethnic cleansing by Jihadi
elements which India alleges and blames on the Inter-Services Intelligence.The
Kashmiri Pandits, a community of Hindu Brahmins, then comprising 5% of the
population of the state were the primary targets of Islamic militants, who also
sought to also eliminate Kashmir's record of 5000 years of Hindu Sanskrit
culture and scholarship as well as the tolerant indigenous multiculturalism
referred to as Kashmiriat.As many as 400,000 Kashmiri Pandits fled the state
and ethnic violence is considered to have killed 30,000 people.Muslim
paramilitaries raped, tortured and killed thousands of Kashmiri Pandits, burnt
their temples, idols and holy books.
According to Bhatt a United Nations adviser, the
houses of Kashmir Pandits have been burnt, many killed, and that there has been
"an almost total ethnic cleansing of Kashmir Pandits from Kashmir by
fundamentalist forces of terrorism organised and supported from Pakistan".
Other minorities such as Kashmiri Sikhs were also targeted.
According to Chitkara the killing of Sikhs near Anantnag in 2001, by the
Jehadis was aimed at ethnic cleansing. Hindus have migrated from most of the
Kashmir valley, Sikhs who form a very small percentage could be forced to
migrate in the wake of such killings.
Something To Think:Kashmir is treated has special state under provision of Article 370.Since Kashmir is concidered has Pride of our Nation.Is it right more than civilan life to hold our pride under army & armed forces?

India:
A Summarized Viewpoint of India provided by
Ministry of External affairs, Government of India

- India
holds that the Instrument of Accession of the State of Jammu and Kashmir to the
Union of India, signed by Maharaja Hari Singh on 25 October 1947& executed
on 27 October 1947between the ruler of Kashmir and the Governor General of
India was a legal act, was completely valid in terms of the Government of India
Act (1935), Indian Independence Act (1947) and international law and was total
and irrevocable.There is no evidence of any deceit practiced by India on
Kashmir. The Government of India had no right to question the right of the
Maharaja to sign the Instrument of Accession, as he alone had the right and
power to take a decision for his state. To have asked the ruler to establish
his right to sign the Instrument of Accession would have meant that the
Government of India was going to meddle with the internal policies of the
state. Law does not permit any such intervention in the affairs of another
state.
- The
Constituent assembly of Jammu and Kashmir had unanimously ratified the
Maharaja's Instrument of Accession to India and had adopted a constitution for
the state that called for a perpetual merger of Jammu and Kashmir with the
Union of India. India claims that the Constituent assembly was a representative
one, and that its views were those of the Kashmiri people at the time.
- United
Nations Security Council Resolution 1172 tacitly accepts India's stand
regarding all outstanding issues between India and Pakistan and urges the need
to resolve the dispute through mutual dialogue and does not call for a
plebiscite.
- United
Nations Security Council Resolution 47 cannot be implemented since Pakistan
failed to withdraw its forces from Kashmir, which was the first step in implementing
the resolution.India is also of the view that Resolution 47 is obsolete, since
the geography and demographics of the region have been permanently altered.The
resolution was passed by United Nations Security Council under Chapter VI of the
United Nations Charter. It is therefore non-binding and has no mandatory
enforceability, as opposed to the resolutions passed under Chapter VII.
- India
does not accept the two-nation theory that forms the basis of Pakistan and
considers that Kashmir, despite being a Muslim-majority state, is in many ways
an "integral part" of secular India.
Pakistan:
- The
popular Kashmiri insurgency demonstrates that the Kashmiri people no longer
wish to remain within India. Pakistan suggests that this means that Kashmir
either wants to be with Pakistan or independent.
- According
to the two-nation theory, which is one of the theories that is cited for the
partition that created India and Pakistan, Kashmir should have been with
Pakistan, because it has a Muslim majority.
- The
Kashmiri people have now been forced by circumstances to uphold their right of
self-determination through militancy. Pakistan claims to give the Kashmiri
insurgents moral, ethical and military support
- Pakistan
points to the violence that accompanies elections in Indian Kashmir and the
anti Indian sentiments expressed by some people in the state.
- Pakistan
has noted the widespread use of extrajudicial killings in Indian-administered
Kashmir carried out by Indian security forces while claiming they were caught
up in encounters with militants. These encounters are commonplace in
Indian-administered Kashmir. The encounters go largely uninvestigated by the
authorities, and the perpetrators are spared criminal prosecution.
- Pakistan
points towards reports from the United Nations which condemn India for its
human rights violations against Kashmiri people.Human rights organizations have
strongly condemned Indian troops for widespread rape and murder of innocent
civilians while accusing these civilians of being militants.
- The
Chenab formula was a compromise proposed in the 1960s, in which the Kashmir
valley and other Muslim-dominated areas north of the Chenab river would go to
Pakistan, and Jammu and other Hindu-dominated regions would go to India.
